Warranty Terms

LINTEC IND. COM. DE MOTORES E EQUIP. MOVIM. MATERIAIS LTDA. warrants Lintec products that, under normal service or use, are found to have defects in materials, workmanship, or assembly, for the periods specified in these warranty terms.

1. WARRANTY PERIOD

1.1 — This engine warranty is valid for a period of 6 (six) months or 500 (five hundred) hours, whichever occurs first, from the actual date of delivery to the purchaser, as recorded in the Sales Record.

2. COVERAGE

2.1 — The warranty covers parts and components installed in the Lintec product that are found to be defective in accordance with item 1.1, except for those specified in items 4.1 through 4.11.

2.2 — This warranty covers labor at no charge for services performed due to any technical problems occurring within the period established in item 1.1.

3. CONDITIONS FOR WARRANTY VALIDITY

3.1 — Use the product properly in accordance with its Technical Specifications and for its intended purpose.

3.2 — Strictly follow the operating and maintenance instructions provided by the supplier in the respective Manual.

3.3 — Keep the original structure of the product unaltered.

3.4 — Use only loads that do not exceed the limits specified by the supplier.

3.5 — Allow this engine to be operated only by qualified personnel using appropriate safety equipment as required by law.

3.6 — Use only suitable fuels and lubricants recommended by the supplier.

3.7 — Have all service work performed exclusively by Authorized Distributors.

3.8 — Submit warranty claims directly to an Authorized Lintec Distributor (LINTEC IND. COM. DE MOTORES E EQUIP. MOVIM. MATERIAIS LTDA.), presenting this manual duly completed.

4. WARRANTY LIMITATIONS

4.1 — Parts proven to be defective and replaced under warranty shall become the property of LINTEC IND. COM. DE MOTORES E EQUIP. MOVIM. MATERIAIS LTDA.

4.2 — The warranty covers necessary repairs or replacement of components proven to be defective due to failure of materials, assembly, or manufacturing. Under no circumstances will the engine itself be replaced.

4.3 — This warranty excludes consumable materials such as: gaskets, grease, lubricating oil, air filter elements, lubricating oil and fuel filter elements, solvents, cleaning materials, fuel, and belts.

4.4 — This warranty applies exclusively to the engine and its parts and components. It does not cover transportation expenses or personal expenses, such as telephone calls, lodging, and other expenses, nor consequential damages or loss of profits, whether direct, indirect, or incurred by third parties. The warranty is limited to repairing the engine or replacing or repairing its parts and components.

4.5 — Travel expenses incurred by the Authorized Distributor to and from the location where the engine is installed are not covered by this warranty.

4.6 — Parts are excluded from the warranty if their defects result from the use of non-genuine parts and/or components that do not maintain the technical characteristics specified by the supplier.

4.7 — This warranty does not cover equipment or modifications/additions installed or performed by third parties on Lintec products.

4.8 — Replacement of defective parts or components with new ones, or services performed during the product warranty period, shall not extend the original warranty period described in item 1.1.

4.9 — Discoloration or alteration of the paint finish caused by improper use of solvents or by natural or accidental wear of the product is excluded from the warranty.

4.10 — This warranty does not cover defects caused by prolonged disuse, accidents of any kind, unforeseen events, or force majeure.

4.11 — This warranty does not cover the costs of removing and installing the engine in machinery or vessels when performed by third parties.

5. WARRANTY TERMINATION

This warranty shall terminate when:

5.1 — The warranty period described in item 1.1 expires.

5.2 — The conditions set forth in these Warranty Terms, particularly those specified in items 3.1 through 3.8, are found not to have been complied with during the period specified in item 1.1.

6. GENERAL PROVISIONS

6.1 — The Supplier reserves the right to introduce modifications to and/or improvements in its designs without any obligation to incorporate such modifications or improvements into products previously manufactured.

6.2 — These Warranty Terms apply exclusively to Lintec products. Commitments made by third parties that differ from these Warranty Terms shall not be the responsibility of the Supplier.

6.3 — LINTEC IND. COM. DE MOTORES E EQUIP. MOVIM. MATERIAIS LTDA. recommends that purchasers of its products, in order to ensure full warranty coverage, consult the Authorized Distributor Network and the Operation Manual regarding the proper and appropriate use of the product.

AGRALE WARRANTY TERMS

1. AGRALE S.A. warrants its products that, under normal service or use, are found to have defects in materials, workmanship, or assembly, for the periods and/or operating hours specified in these Warranty Terms.

2. WARRANTY PERIOD

2.1 The warranty for this engine is valid for a period of 12 (twelve) months or 700 (seven hundred) hours, whichever occurs first, from the actual date of delivery to the purchaser, as recorded in the Sales Record.

Note: The warranty period above is divided as follows: 3 (three) months of statutory warranty and 9 (nine) months of contractual warranty.

3. WARRANTY COVERAGE

3.1 The warranty covers parts and components installed in the AGRALE product that are found to be defective in accordance with item 2.1, except for those specified in items 5.1 through 5.12.

3.2 This warranty covers, at no charge, the labor associated with services performed during the Delivery Inspection.

3.3 This warranty covers, at no charge, labor associated with services performed due to any technical problems occurring within the period established in item 2.1.

4. CONDITIONS FOR WARRANTY VALIDITY

4.6 Use only suitable fuels and lubricants recommended by AGRALE S.A.

4.7 Have all service work performed exclusively by Authorized AGRALE Distributors.

4.8 Submit warranty claims directly to an Authorized AGRALE Distributor, presenting this Manual duly completed.

4.9 Do not tamper with or break any seals applied by the manufacturer.

5. WARRANTY LIMITATIONS

5.1 Parts proven to be defective and replaced under warranty shall become the property of AGRALE S.A.

5.2 The warranty covers necessary repairs or the replacement of components proven to be defective due to failure of materials, assembly, or manufacturing. Under no circumstances will the engine itself be replaced.

5.3 This warranty excludes expenses related to the following maintenance items: filter elements, lubricants/oils, grease, gaskets in general, testing and adjustments, general retightening, solvents, and cleaning materials.

5.4 This warranty applies exclusively to the engine and its parts and components. It does not cover towing or transportation expenses or personal expenses, such as telephone calls, lodging, and other expenses, nor consequential damages or loss of profits, whether direct, indirect, or incurred by third parties. The warranty is limited to repairing the engine or replacing or repairing its parts and components.

5.5 Travel expenses incurred by the Authorized AGRALE Distributor to and from the location where the engine is installed are not covered by this warranty.

5.6 Parts are excluded from the warranty if their defects result from the use of non-genuine parts and/or components that do not maintain the technical characteristics specified by AGRALE S.A.

5.7 This warranty does not cover equipment or modifications/additions installed or performed by third parties on AGRALE products.

5.8 Replacement of defective parts or components with new ones, or services performed during the product warranty period, shall not extend the original warranty period described in item 2.1.

5.9 Discoloration or alteration of the paint finish caused by improper use of solvents or by natural or accidental wear of the product is excluded from the warranty.

5.10 This warranty is non-transferable.

5.11 This warranty does not cover defects caused by prolonged disuse, accidents of any kind, unforeseen events, or force majeure.

5.12 Engine components such as the injection pump, injectors, alternator, and starter motor, as well as the generator assembly, are covered by the respective manufacturers' warranties. These components must be taken to an AGRALE Distributor, which will forward them to the manufacturer's respective Authorized Representatives for warranty service, provided that the warranty period specified in item 2.1 has not expired.

6. WARRANTY TERMINATION

This warranty shall terminate when:

6.1. The warranty period described in item 2.1 expires.

6.2. During the period specified in item 2.1, it is determined that the conditions set forth in these Warranty Terms, particularly those specified in items 4.1 through 4.9, have not been complied with.
